One of the hardest things in life is to watch
those we love and care about get older and become unable to care for
themselves. Often unable to move our elderly family into our homes,
we face the heart-wrenching decision to place them into nursing
homes. According to the National Center for Health Statistics, there
are more 18,000 nursing homes, which currently care for 1.6 million
elderly residents. With the number of residents increasing
exponentially and expected to quadruple by 2050, some facilities are
struggling to keep up with the demand, resulting in staff shortages,
stressful working conditions, and inadequate training.
The Government Accountability Office’s 2002 investigation revealed
that 30 percent of nursing homes have been cited by state inspectors
for violations that “harmed residents or placed them in immediate
jeopardy,” and that amazingly 50 percent of nursing homes waited
“days or weeks” to report these incidents, despite laws requiring
such instances to be reported within 24 hours. Commenting on this
report at the time, Sen. John Breaux (D-La.) proclaimed that “a
crime is a crime, whether in or outside of a nursing home, where
residents should not spend their days living in fear.”
But in its most recent study, the National Center on Elder Abuse
found that there was a 19.7 percent increase of elderly abuse
reports. Despite this alarmingly increasing trend, the National
Center on Elder Abuse further stated that “eye witness accounts and
surveys have sadly shown that nursing home abuse and neglect is a
serious problem, and that there also is significant underreporting.”

Nursing home abuse can include physical injury
from
falls,
malnutrition, dehydration, bed sores, gangrene, aspiration
pneumonia, over-sedation, poor medical care, or incorrect
medication. Just as damaging, but subtler, are lack of supervision,
abandonment, ineffective equipment, sexual assault, and physical or
mental abuse. All of these can lead to the injury or death of
nursing home residents.
Additionally, abuse can involve the inappropriate
use of
physical restraints, which include tie–downs or straps. If restraints are
left in place too long, bruises may result. Freedom of movement becomes
limited, and over a period of time the use of restraints may result in
deconditioning and muscle atrophy.
Similarly, nursing home residence should not be given drugs to
restrain
them, unless these medications are required to treat their medical symptoms.
Overmedicating a nursing home resident with tranquilizing drugs for the
convenience of the staff is abusive. Employing psychotherapeutic or
antipsychotic drugs or withholding pain medication for patient discipline is
also abusive.

injuries in various stages of healing; burns (commonly on soles, palms, or
buttocks), laboratory evidence of medication overdose or failure to
administer prescribed drugs, an elder residence’s report of abuse; an elder
residence’s sudden withdrawn behavior; and/or the refusal of a caretaker to
allow visitors to see the elder alone.
